Privacy Policy
This Privacy Policy explains how Yasuke Consulting (Pty) Ltd (“Yasuke”, “we”, “our”) collects, uses and protects personal information you share with us through this website (yasuke.co.za) and in the course of our general business activities.
We are the responsible party (data controller) for the personal information described below, and we process it in line with the South African Protection of Personal Information Act, 2013 (POPIA) and, where applicable, the EU General Data Protection Regulation (GDPR).
If you are looking for the policy that covers messaging data processed through the WhatsApp Business API solutions we build for clients, see our WhatsApp Business API Privacy Policy.
1. Information we collect
We collect only what we need to run our website and respond to enquiries.
- Contact form submissions ‐ name, email address, phone number (optional), company (optional), the services you are interested in, and the content of your message.
- Email correspondence ‐ if you email us directly, we retain the message and any attachments.
- Technical data ‐ your IP address and basic request metadata are captured in our server logs for security and abuse prevention. IP is also recorded against contact-form submissions to detect spam.
- Analytics data ‐ we use Google Analytics to understand how visitors use the site (pages viewed, approximate location, device and browser). This is collected via cookies. See section 4.
2. How we use your information
- To respond to enquiries and provide the information or services you have requested.
- To send you an automated confirmation that we have received your message.
- To maintain the security and integrity of the website and prevent spam or abuse.
- To understand how the site is being used so we can improve it.
- To meet our legal and regulatory obligations.
We do not sell your personal information, and we do not use website enquiry data for unrelated marketing.
3. Legal basis for processing
- Consent ‐ when you submit the contact form or accept analytics cookies.
- Legitimate interests ‐ for site security, spam prevention and basic analytics, balanced against your rights.
- Legal obligation ‐ where retention or disclosure is required by law.
4. Cookies and analytics
The site uses cookies for two purposes:
- Essential cookies that keep the site functioning correctly.
- Google Analytics cookies (managed by Google LLC) that measure aggregate site usage. These may transfer data outside South Africa.
The first time you visit the site we show a consent banner. Google Analytics is only loaded if you click Accept. If you click Reject, no analytics cookies are set and no analytics data is sent. You can change your choice at any time using the button below, or by blocking or deleting cookies in your browser settings.
5. How long we keep information
| Data | Retention |
|---|---|
| Contact form enquiries | Up to 24 months from the last correspondence |
| Ongoing client communication | For the duration of the client relationship and as long as needed to meet legal, tax and audit obligations |
| Server access logs | Up to 30 days |
| Google Analytics data | As per Google’s default retention (currently 14 months) |
6. Sharing your information
We only share personal information with:
- Service providers that help us run our business ‐ email delivery, website hosting and analytics. Each is bound by contractual obligations to protect your information.
- Legal or regulatory authorities where we are required by law to disclose information.
Our current key providers include Google (Analytics), Microsoft (email and cloud services), and our website hosting provider.
7. Cross-border transfers
Some of our service providers process data outside South Africa (for example, Google Analytics). Where personal information is transferred across borders, we rely on the safeguards permitted under section 72 of POPIA and, for EU data subjects, on Standard Contractual Clauses or equivalent mechanisms.
8. Security
We protect personal information with reasonable technical and organisational measures, including encryption in transit (TLS), access controls, spam and abuse protection on the contact form, and regular patching of our systems. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security.
9. Your rights
Subject to the law that applies to you, you have the right to:
- Ask what personal information we hold about you.
- Ask us to correct or update information that is inaccurate.
- Ask us to delete your information, subject to legal retention obligations.
- Object to processing or withdraw consent at any time.
- Lodge a complaint with the South African Information Regulator (inforegulator.org.za) or, if applicable, your local EU data protection authority.
10. Children
Our website and services are not directed at children under the age of 18 and we do not knowingly collect personal information from children. If you believe a child has provided personal information to us, please contact us and we will delete it.
11. Changes to this policy
We may update this policy from time to time to reflect changes in our practices or applicable law. The “Last updated” date at the top of the page reflects the most recent revision.
